1. General Information
1.1. The Fribourg International Film Festival (FIFF) uses a specialised system for ticket sales, as well as the www.fiff.ch website.
1.2. These General Terms and Conditions of Sale govern the use of the FIFF website and services, and more specifically the purchase of tickets via the FIFF ticketing system. By ticking the box: “I have read and understood these General Terms and Conditions of Sale and accept them", the customer acknowledges having accepted these General Terms and Conditions of Sale and agrees to adhere to them.
2. Ticketing System
2.1. The FIFF and its suppliers strive to provide the customer with quality professional services according to generally accepted practices. To this end, the FIFF uses proven technology and enlists the aid of qualified suppliers and professionals (hereafter referred to collectively as “suppliers”) while exercising all due diligence. Nevertheless, the FIFF can in no way guarantee that it can provide impeccable and uninterrupted FIFF services or rule out the occurrence of security breaches in the IT system or improper use by unauthorised third parties. The FIFF disclaims all liability, to the extent of the law, for damages that may result from such wrong-doing, including for services provided by third parties.
2.2. To use the services of the FIFF, the customer makes use of his own hardware (including printer), software and telecommunications connection at his or her own cost and risk. The customer acknowledges that the FIFF and its suppliers/licensors are not required to provide support for or maintain certain software, platforms or operating systems, or guarantee their support in the future. The FIFF disclaims all liability, to the extent of the law, for any damage that may occur to the customer's computer system, and which could be linked to using the website or services.
2.3. The customer unconditionally accepts responsibility for any payment required to use FIFF services. The customer will take reasonable steps to prevent disclosure of his or her password, use by third parties or any improper use. If there is reason to believe that the password has been misused, the customer must notify the FIFF immediately (email@example.com) and, to the extent of the law and within the scope of his or her liability, spare FIFF and its suppliers from any damage resulting from improper or unauthorised use of the website or services. In any event, if the FIFF suspects any improper or unauthorised use, it may interrupt or refuse to provide services.
3.1. The customer accepts that purchasing tickets and/or using the other services offered on the FIFF website gives rise to certain rights and obligations.
3.2. Tickets are checked on-site, at the entrance, using an electronic system. The ticket holder's identity may be verified. Screenings cannot be attended without prior reservations. The reservation guarantees access to the screening room up until the screening begins.
3.3. Only tickets obtained directly from an official sales channel are valid. Any reproduction, modification or copying of tickets is prohibited. Tickets are non-transferable and must be kept dry, clean and free from any deterioration, physical or otherwise, that may affect legibility, etc. The bar codes must be readable by a machine.
3.4. If the ticket was not validated at the entrance, it must be kept until the end of the event and presented upon request. Any improper use of the ticket is prohibited. Instructions given by the FIFF staff must be followed. Any violation may result in a claim for damages and interest, along with losing the right to attend the event.
3.5. Tickets cannot be refunded or exchanged unless the event is cancelled, as set out in subsection 3.6 below.
3.6. If the event is postponed, tickets will remain valid. If the event is cancelled outright, tickets are refundable up to 30 days after the cancellation was announced. If the ticket was bought on the FIFF website and paid for by bank card, the refunded amount is credited to the card holder’s bank account. In all the other cases, the ticket must be returned to a FIFF point of sale.
3.7 The FIFF is responsible for refunding the ticket price. The refund or credit amount can in no way be greater than the ticket’s purchase price.
4. Personal Data
4.1. The customer acknowledges having accepted that his or her personal data may be transmitted to suppliers as part of providing and managing the website and services. The FIFF will endeavour to make every commercially reasonable effort to guarantee the confidentiality of these data in accordance with the law.
5.1. The FIFF will make every effort to ensure that the data published on the website is complete, up-to-date and accurate. Nevertheless, the FIFF cannot provide any guarantee that the information made available on the website is indeed complete, up-to-date, accurate and free from errors in its transmission. The FIFF cannot be held liable for any damages and wrong-doing that may result in consequence. The customer particularly acknowledges that the FIFF cannot provide any guarantee concerning the content published on third-party websites accessible via the FIFF website; the FIFF disclaims all liability in this regard.
6. Rights pertaining to the FIFF website and ticketing system.
6.1. The FIFF website and ticketing system are protected by copyright law as well as other legal provisions. All related rights, including ownership and/or user rights, belong to the FIFF and/or its suppliers/licensors.
7. Revision of the General Terms and Conditions of Sale
7.1. The FIFF reserves the right to amend or modify its General Terms and Conditions of Sale at any time. The customer will be notified of these changes in an appropriate manner, particularly by posting a message on the FIFF website. We thus urge you to visit the FIFF website frequently.
8. Applicable Law and Jurisdiction
8.1. Swiss law applies.
In the event of any dispute arising from the use of the website or services, the court of competent jurisdiction will be that located in the city of the FIFF head office.
