General Terms and Conditions

1. General provisions

1.1. Image rights

Any person who attends a screening as part of the Fribourg International Film Festival (FIFF) or is physically present at a FIFF venue grants the Festival the right to record, use, manage and depict their image and voice on any medium for the purposes of the Festival and its promotion, including photographs, live broadcasts on a large screen, live or delayed television broadcasts, as well as video or audio broadcasts and/or recordings. This right is granted to FIFF free of charge, for the entire world and for the term of copyright. Furthermore, FIFF may freely transfer these rights to a third party of its choosing.

1.2. Security

FIFF undertakes to secure the Festival venues as far as possible but may not be held liable for damage of any kind.

Members of the audience undertake to comply with the safety measures prescribed by FIFF. Non-compliance may lead to the removal of the person causing the disruption from the Festival venues as well as the confiscation of their Ticket, Festival Pass or Accreditation. Audio and/or visual recordings of any kind is prohibited and may lead to removal, without refund, from the Festival.

It is strictly prohibited to carry the following items into the screening venues: weapons, explosive, flammable or volatile substances, sharp or blunt objects, any object that could be used as a projectile, hazardous objects or pyrotechnic articles, as well as political, ideological, religious and advertising banners and signs of all sizes. Any person who contravenes this provision will be held liable and may be prosecuted.

1.3. Application of the General Terms and Conditions (GTC) and the General Terms and Conditions of Sale (GTCS) (see Article 2 below)

If one or more of the provisions set out in these General Terms and Conditions (GTC and GTCS) are or become either null and void or unenforceable, whether wholly or in part, the validity of the remaining provisions (GTC and GTCS) and the purchase of Tickets, Festival Passes and Accreditations shall remain unaffected. Any provision that is null and void or unenforceable will be replaced by the parties.

1.4. Changes in the General Terms and Conditions and General Terms and Conditions of Sale (GTCS)

FIFF reserves the right to change the present GTCS at any time. Notification of amendments will be published on the FIFF website. The revised provisions will enter into force at the time of their publication online.

2. General Terms and Conditions of Sale

2.1. General provisions

FIFF operates a specialised system for the sale of tickets, including the website 'fiff.ch'.

The present GTCS govern the use of the FIFF website and services, in particular the purchase of tickets via the FIFF ticketing system. By clicking on the box "I have read and accept the General Terms and Conditions of Sale", the customer declares that they agree to be bound by and comply with the same.

2.2. Ticketing system

FIFF and its suppliers endeavour to deliver professional and quality services in accordance with accepted professional standards. To this end, FIFF employs professionals and qualified service providers (hereinafter collectively referred to as 'service providers'), and will exercise due diligence in this regard. However, FIFF cannot guarantee that its services will be provided without fault or interruption, nor can it exclude breaches or abuse of its IT system by unauthorised third parties. To the extent permitted by law, FIFF does not accept responsibility for any damage resulting from such actions, or for services provided by third parties.

The customer uses, at their expense and risk, their own hardware (including printer), software and telecommunications system to access FIFF services. The customer acknowledges that FIFF and its service providers have no obligation to support or maintain certain software, platforms or operating systems, or to guarantee their support in the future. To the extent permitted by law, FIFF declines all responsibility for any damage to the customer's computer system that may be connected with the use of the FIFF website and services.

The customer acknowledges without reserve that all services accessed via the customer's account will be charged to the same. The customer pledges to take all reasonable steps to prevent the disclosure of their password, and its unauthorised use or misuse by third parties. If they have reason to suspect that their password may have been misused, the customer must notify FIFF (info@fiff.ch) immediately and, insofar as it is permitted under law, protect FIFF and its service providers from any damage, within the customer's sphere of responsibility, which arises from the misuse, unauthorised use or manipulation of the FIFF website or services. If FIFF suspects that misuse or unauthorised use has occurred, it shall suspend or block all services provided to the account concerned.

2.3. Liability of Festival Pass or Single Ticket purchasers and Accreditation holders

The purchaser bears sole responsibility for their Ticket. The seller does not accept liability in the event of the loss, theft or authorised use of said ticket.

FIFF does not accept liability for any error that may occur during the booking, processing or printing of the print-at-home Ticket insofar as the error was not committed deliberately by FIFF or was the result of negligence on the part of FIFF. The purchaser will not be issued with duplicate copy of the ticket or re-issued with any kind of ticket, other than the original print-at-home ticket. The Ticket may not be printed, under any circumstances, at the event venue.

The purchaser does not have to carry a physical ticket. They may store it on a mobile phone or tablet and present the device at the entrance to the venue.

3. Passes and accreditations

The purpose of the present GTCS is to establish the terms under which a person agrees to purchase a Festival pass ('Pass') or Festival accreditation ('Accreditation') from FIFF that grant the holder admission to screenings held during the Festival. The present GTCS apply to all persons. FIFF reserves the right to change the present terms at any time and without prior notice. The GTCS valid on the date on which the Pass or Accreditation is purchased shall apply.

3.1. Festival Passes

FIFF may offer one or more of the following Festival Passes for sale, subject to availability.

3.2. Accreditation

Accreditation is not transferable and requires photo ID. It entitles the holder to one admission per time slot for the entire duration of the Festival (maximum x admissions/day).

3.3. Loss or damage

In the event of loss of or damage to an Accreditation or a Pass, FIFF will issue a copy upon request. However, lost or damaged 'Five Admissions' and 'Day' passes will not be replaced.

4. Tickets

4.1. Subject

The purpose of the present GTCS is to establish the terms under which a person agrees to purchase a reservation ('Ticket') from FIFF, granting them admission to one screening. Admission to a screening during the Festival requires the presentation of a Ticket, either in the form of a paper ticket or a Pass or Accreditation (see previous Section). FIFF reserves the right to change the present terms at any time and without prior notice. The GTCS which were valid on the date of purchase of a Pass or Accreditation shall apply.

4.2. Rights and obligations

The customer accepts that the purchase of tickets and/or the use of other services offered on the FIFF website give rise to rights and obligations.

4.3. Checks

Tickets are checked electronically at the entrance to the given screening venue. FIFF also reserves the right to ask for additional proof that the person presenting the ticket is its rightful holder. This will be the case for discounted tickets (including Passes). Admission to screenings is subject to a prior seat reservation, which guarantees the holder access to the screening venue until the film begins.

4.4. Validity

Only tickets procured directly through an official sales channel are deemed valid. Any reproduction, alteration or imitation of tickets is prohibited. Tickets are non-transferable and must be protected from moisture, dirt, damage as well as optical and mechanical stress so that the barcode can be read by machine.

If the ticket is not checked at the entrance to the venue, the holder must not dispose of it so that it can be presented, on request, at the end of the screening. Any misuse of the ticket is prohibited. Ticket holders must follow all instructions issued by FIFF staff.

4.5. Returns and exchanges

Unless an event is cancelled, tickets may not be returned or exchanged (see the following Section).

4.6. Postponement/cancellation

Should the event be postponed, all tickets will remain valid. If the event is cancelled definitively, holders may request a refund up to 30 days after the cancellation is announced. If the ticket has been purchased by credit card on the FIFF website, the price will be credited to the bank account of the card holder. In all other instances, the ticket must be returned to a FIFF point of sale.

4.7. Refund

Responsibility for refunds of the ticket price lies with FIFF. The amount refunded or credited to an account will not exceed the purchase price of the ticket.

5. Cancellation of a Pass, Accreditation or Ticket

If FIFF identifies the abusive use of a Pass, an Accreditation or a Ticket, it reserves the right to cancel the given form of admission. Any abuse or infringement may result in the forfeiture of the right to attend the event and/or to claim damages and interest.

6. Personal data

The customer acknowledges and agrees that their personal data may be disclosed to the suppliers in connection with the operation and management of the FIFF website and the provision of services by the Festival. FIFF undertakes to use commercially reasonable efforts to guarantee the confidentiality of this data as required under the law.

For more details on the collection and use of personal data on the FIFF website, please refer to the 'Data Protection' page.

FIFF will make every effort to ensure that all information published on its website is complete, current and accurate. However, FIFF cannot guarantee the completeness, currency and accuracy of information published on the website nor can it be held liable for any data transmission errors or for any damages or actions arising from these errors. The customer acknowledges that FIFF cannot guarantee or be held liable for content published on third-party sites which are accessible from the FIFF website.

8. Rights in connection with the FIFF website and ticketing system

The FIFF website and ticketing system are protected by copyright and other laws. All rights pertaining to the same, including ownership and/or usufructuary rights, are held by FIFF and/or its suppliers.

9.    Applicable law and place of jurisdiction

The present conditions are subject to Swiss law.
